Public Offer

This Public Offer (the "Offer") is an official proposal by TopWork(the "Operator") to enter into an agreement for the use of the online platform available at https://topwork.kz (the "Platform") on the terms set out below.

1. General Provisions

This Offer is addressed to any legally capable individual or legal entity (the "User"). Acceptance of this Offer occurs when the User registers an account, signs in, or otherwise starts using the Platform. From the moment of acceptance, an agreement is deemed concluded between the Operator and the User on the terms of this Offer, the Terms of Service, and the Privacy Policy.

2. Subject of the Agreement

The Operator provides the User with access to Platform functionality for posting and viewing job vacancies, resumes, company information, and related tools for job search and hiring. The scope of available features may depend on the User's role and account status.

3. Rights and Obligations of the Operator

  • provide access to the Platform in accordance with its current functionality;
  • take reasonable measures to maintain Platform availability and security;
  • process personal data in accordance with the Privacy Policy;
  • modify, update, or discontinue Platform features with or without prior notice;
  • suspend or restrict access in case of violations or security risks.

4. Rights and Obligations of the User

  • use the Platform only for lawful purposes;
  • provide accurate and up-to-date information;
  • not infringe the rights of third parties or applicable law;
  • keep account credentials confidential;
  • independently assess the suitability of job offers, candidates, and counterparties.

5. Fees

Basic access to the Platform may be provided free of charge. Paid features, if introduced, will be described on the Platform and/or in separate commercial terms. Unless otherwise stated, use of free features does not create payment obligations.

6. Liability

The Platform is provided on an "as is" basis. The Operator is not liable for hiring decisions, the accuracy of user-generated content, temporary interruptions, or losses arising from the User's use of information obtained through the Platform, except where liability cannot be limited under applicable law.

7. Personal Data

By accepting this Offer, the User consents to the processing of personal data as described in the Privacy Policy, including data received through third-party authentication providers used to sign in to the Platform.

8. Term and Termination

The agreement remains in force while the User uses the Platform. The User may stop using the Platform at any time. The Operator may terminate or suspend access if the User breaches this Offer or applicable rules.

9. Amendments

The Operator may amend this Offer by publishing an updated version on this page. Continued use of the Platform after publication constitutes acceptance of the amended Offer.

10. Governing Law and Disputes

This Offer is governed by the laws of the Republic of Kazakhstan. Disputes shall be resolved through negotiation where possible, and otherwise in accordance with applicable law.
